1. Scope of Agreement

1.1 Parties to Agreement

This Agreement is an agreement concluded between you and Beijing Ruichi Sifang Automotive Technology Co., Ltd. (hereinafter referred to as "the Company" or "we") regarding the use of the Smart Elderly Care Health Management System (hereinafter referred to as "this System" or "this Service").

1.2 Agreement Content

The contents of this Agreement include the main body of the agreement, individual service agreements, privacy policy, and all rules and operational procedures that have been published or may be published in the future. All rules are an integral part of this Agreement and have the same legal effect as the main body of the agreement.

1.3 User Definition

"User" or "You" in this Agreement refers to the individual who registers, logs in, and uses this service, including:

• Elderly User: Elderly person residing in an elderly care facility and using health monitoring services
• Family User: Relatives of the elderly who view the elderly's health status through this system
• Care User: Nursing staff of the elderly care facility who use this system to provide care services
• Management User: Management personnel of the elderly care facility who use this system for management

2. Account Registration and Use

2.1 Registration Eligibility

You confirm that before you start the registration process to use this service, you should have the civil capacity commensurate with your actions as stipulated by the laws of the People's Republic of China. If you do not have the aforementioned subject qualification, please read this Agreement accompanied by your guardian and complete registration under the guidance of your guardian.

2.2 Registration Information

You should provide true, accurate, complete and legal registration information and update it in a timely manner. Any problems caused by untrue, inaccurate, incomplete or changed registration information shall be borne by you accordingly, and we have the right to suspend or terminate the provision of services to you.

2.3 Account Security

You are responsible for properly keeping your account information and password, and are responsible for all activities under your account. You agree:

• Not to disclose account or password information to others
• To notify us immediately if you find unauthorized use of your account
• To ensure safe logout from your account after each use

2.4 Account Transfer

Your account is for your personal use only and may not be transferred, leased or lent to others in any form. Otherwise, we have the right to suspend or terminate providing services to you, and reserve the right to pursue your liability.

3. Service Content

3.1 Service Description

This system is a smart elderly care health management platform developed by our company, mainly providing the following services:

• Health Monitoring: Real-time monitoring of health indicators such as heart rate, blood pressure, and blood glucose through Huawei wearable devices
• Anomaly Alert: Automatic alerts to nursing staff and family members when health data is abnormal
• Health Reports: Generation of health trend analysis reports such as daily, weekly, and monthly reports
• Remote Care: Family members can remotely view the elderly's health status through mobile phones
• Care Management: Assisting elderly care facilities with care task management and work records
• Emergency Call: Providing one-click emergency call function

3.2 Service Forms

We may provide services to you through the following forms:

• WeChat Mini Program
• Web-based management backend
• API interface services
• SMS notification services
• Other forms

3.3 Service Changes

We have the right to change, suspend, restrict, terminate or withdraw some service functions according to business development needs. In case of major changes, we will notify you in advance through appropriate means.

4. User Conduct Guidelines

4.1 Information Content Standards

You must not produce, copy, publish, or disseminate information containing the following content:

• Opposing the basic principles established by the Constitution
• Endangering national security, leaking state secrets, subverting state power, or undermining national unity
• Damaging national honor and interests
• Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity
• Undermining national religious policies, promoting cults and feudal superstitions
• Spreading rumors, disturbing social order, or undermining social stability
• Spreading obscenity, ***ography, gambling, violence, murder, terror, or inciting crime
• Insulting or defaming others, infringing upon the legitimate rights and interests of others
• Containing other content prohibited by laws and administrative regulations

4.2 Software Usage Standards

Unless permitted by law or with our written permission, you must not engage in the following activities:

• Deleting copyright information on the software and its copies
• Reverse engineering, reverse assembling, reverse compiling the software, or otherwise attempting to discover the source code of the software
• Using, leasing, lending, copying, modifying, linking, reproducing, compiling, publishing, publishing, or establishing mirror sites for content that we own intellectual property rights to
• Copying, modifying, adding, deleting, hooking up or creating any derivative works of data released to any terminal memory during software operation, interactive data between client and server during software operation, and system data necessary for software operation
• Operating or disseminating to the public software or methods for modifying or forging instructions and data in software operation, adding, deleting, or changing software functions or operation effects
• Logging in or using software and services through third-party software, plug-ins, add-ons, or systems not developed or authorized by us
• Interfering with this software and its components, modules, and data by yourself or authorizing others or third-party software

4.3 Service Operation Standards

Unless permitted by law or with our written permission, you must not engage in the following activities:

• Submitting or publishing false information, or impersonating or using others' names
• Inducing other users to click on link pages or share information
• Fabricating facts or concealing the truth to mislead or deceive others
• Infringing upon others' legitimate rights such as reputation rights, portrait rights, intellectual property rights, and trade secrets
• Using this service to conduct commercial activities without our written permission
• Other behaviors that violate laws, regulations, policies, public order and good customs, or interfere with the normal operation of this service

5. Privacy Protection

5.1 Health Data Authorization

You understand and agree that to provide health monitoring services, we need to collect your health data, including but not limited to:

• Physiological indicator data collected through Huawei wearable devices
• Health information and medical history you actively input
• Care information recorded by nursing staff

5.2 Data Sharing

You agree that we share your information within the following scope in accordance with the provisions of the Privacy Policy:

• Sharing with the elderly care facility where you reside for providing care services
• Sharing with your emergency contacts for emergency notification
• Sharing with Huawei Company for obtaining health data services
• When required by law or government regulatory needs

5.3 Data Security

We promise to take reasonable security measures to protect your personal information, but cannot guarantee absolute security. If a security incident such as personal information leakage occurs, we will inform you in a timely manner as required by laws and regulations.

6. Intellectual Property Rights

6.1 Our Intellectual Property Rights

Any information or materials contained in this service (including but not limited to text, graphics, audio, video and/or software, including but not limited to charts, animations, audio, video, interface design, data and programs, code, and documents contained in the software) are protected by copyright law, trademark law and/or other laws and regulations. Without the written consent of relevant rights holders, you may not use such information or materials in any way.

6.2 User Content Authorization

For content (including but not limited to text, pictures, videos, audio, etc.) that you upload, submit, store or send when using this service, you grant us a global, free, non-exclusive, sublicensable license, and we can use, copy, modify, adapt, publish, translate, create derivative works, disseminate, perform and display such content.

7. Disclaimer

7.1 Service Availability

We try our best to maintain the normal operation of the service, but cannot guarantee:

• The service will not be interrupted or error-free
• All defects can be corrected
• The service is always available, reliable, and error-free

7.2 Data Accuracy

Health monitoring data may be affected by device accuracy, wearing method, environmental factors, etc., and the data is for reference only. We are not responsible for any losses caused by inaccurate data.

7.3 Emergency Situations

The emergency call function of this system is only an auxiliary tool and cannot replace professional emergency services. In emergency situations, please call 120 or other emergency phone numbers immediately.

7.4 Liability Limitation

In any case, our maximum compensation for your direct losses shall not exceed the total amount of fees you paid to us for using this service.

8. Agreement Changes and Termination

8.1 Agreement Changes

We have the right to revise this Agreement from time to time as needed and publish the revised agreement on this page. If you do not agree with relevant changes, please stop using this service. Continued use of this service indicates your acceptance of the revised agreement.

8.2 Agreement Termination

This Agreement terminates under the following circumstances:

• You actively cancel your account
• You violate the provisions of this Agreement and we terminate providing services to you
• We stop related services based on business adjustments
• Other circumstances requiring termination according to legal provisions

8.3 After Agreement Termination

After the agreement terminates, we will handle your personal information in accordance with the provisions of the Privacy Policy. The remaining data in your account will be retained for a reasonable period and then deleted or anonymized.

9. Governing Law and Dispute Resolution

9.1 Governing Law

The conclusion, execution, interpretation and dispute resolution of this Agreement shall be governed by the laws of mainland China.

9.2 Dispute Resolution

Any dispute arising from or in connection with this Agreement shall be resolved through friendly negotiation between both parties; if negotiation fails, either party has the right to submit the dispute to the Beijing Arbitration Commission for arbitration in accordance with its then-effective arbitration rules.

9.3 Clause Severability

If any clause in this Agreement is deemed invalid or unenforceable for any reason, that clause shall be restricted or excluded to the minimum necessary extent without affecting the validity and enforceability of other clauses.

10. Other Clauses

10.1 Notice Delivery

During the performance of this Agreement, written notices sent by us to you, including but not limited to modifications of this Agreement, service changes, important events, etc., can be delivered through webpage announcements, station letters, emails, SMS, etc. Such notices are deemed delivered on the date of sending.

10.2 Entire Agreement

This Agreement constitutes the entire agreement between you and us regarding this service, superseding all prior oral or written agreements.

10.3 Rights Reservation

Our failure to exercise or enforce any right or provision of this Agreement does not constitute a waiver of such right or provision.

10.4 Assignment

You may not assign the rights or obligations under this Agreement without our written consent. We have the right to assign the rights and obligations under this Agreement to affiliated companies or acquirers.
